1. Who we are and what this is

Emerge is a habit and personal-growth app operated by Amar Mohay, trading as Emerge, based in the United Kingdom (“we”, “us”). By using Emerge, you agree to these terms. If you don’t agree, please don’t use the app.

You must be at least 13 years old to use Emerge. If you are under 18, you should have a parent or guardian’s permission.

2. What Emerge is - and isn’t

Emerge helps you set goals, build habits, reflect, and have AI-powered conversations designed to support personal growth.

Emerge is not a medical, psychological, or therapeutic service. The app’s content and AI features - including conversations with your “future self” - are for motivation, reflection and self-organisation only. They are not medical advice, mental-health treatment, therapy, or a substitute for professional care. If you are struggling with your mental health, please speak to a qualified professional or a support service in your country. Nothing in the app should be relied on for medical, financial, or legal decisions.

3. AI features

Parts of Emerge are generated by artificial intelligence. AI-generated content can be inaccurate, incomplete, or a poor fit for your circumstances. It reflects patterns in language, not knowledge of you as a person. Use your own judgment, and treat suggestions as prompts for your thinking rather than instructions. We don’t guarantee any particular outcome from using the app - lasting change depends on you.

4. Price

Emerge is currently free to download and use. We may introduce paid features or subscriptions in the future; if we do, they will be offered through Apple’s App Store, clearly priced before you commit, and these terms will be updated to cover them.

5. Your content

Everything you write in Emerge - your visions, goals, journal entries, and messages - belongs to you. You grant us a limited licence to process that content solely to operate the app for you (for example, sending your message to our AI provider to generate a reply). We claim no other rights over it. See our Privacy Policy for how your data is handled.

6. Acceptable use

You agree not to: use the app for anything unlawful; attempt to access, probe, or disrupt our systems or AI infrastructure beyond normal use of the app; use automated means to extract data or generate requests; reverse-engineer the app except where the law permits; or resell or redistribute the service.

We may suspend or terminate access that breaches these terms or abuses the AI service. Where reasonable, we’ll warn you first.

7. Our content

The app, its design, branding, text, artwork (including the bonsai tree), and software are owned by us or our licensors and protected by intellectual-property law. We grant you a personal, non-transferable, non-exclusive licence to use the app on Apple devices you own or control, as permitted by the App Store terms.

8. Ending things

You can stop using Emerge at any time and delete your data from inside the app. We may withdraw or change the service, or these terms, with reasonable notice. If we make material changes to these terms, we’ll tell you in the app before they take effect; continued use after that means the new terms apply.

9. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded under UK law. Nothing in these terms affects your statutory rights as a consumer.

Subject to that: the app is provided “as is”; we are not liable for losses that were not foreseeable when you started using the app, losses not caused by our breach, or business losses; and our total liability to you is limited to the amount you paid us in the 12 months before the claim arose.

10. Apple

These terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the app and is not responsible for addressing any claims relating to it, including product liability, legal compliance, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.

11. General

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction - though if you live in Scotland or Northern Ireland, you may also bring proceedings there. If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it.
